These Terms of Service ("Terms") govern your use of Bloomest, a mobile application providing emotional support, gentle guidance, and practical resources for early motherhood.

Important: Bloomest provides supportive and informational content only. It is not a substitute for professional medical care, mental health treatment, or emergency services.

  • Subscription-Based: Bloomest offers paid subscriptions with a free trial period

  • Right to Withdraw: EU, UK, and Brazilian users have statutory cancellation rights (14 days for EU/UK, 7 days for Brazil)

  • Apple App Store: If you downloaded from the Apple App Store, Apple may enforce these Terms as a third-party beneficiary

1. Eligibility and Account Requirements

Who Can Use Bloomest

To use Bloomest, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)

  • Use the service for personal, non-commercial purposes as a consumer

  • Not be located in a country subject to U.S. government embargo or designated as a "terrorist-supporting" country

  • Not be on any U.S. government list of prohibited or restricted parties

Account Responsibility

  • You are responsible for maintaining the confidentiality of your account credentials

  • All activity under your account is your responsibility

  • Notify us immediately if you suspect unauthorized access

2. How Bloomest Works

What We Provide

Bloomest offers:

  • AI-Powered Support: Conversations with Laurence, our AI assistant designed for postpartum emotional support

  • Practical Resources: Guidance and information for early motherhood

  • Community Features: Access to supportive content and tools

  • Personalized Experience: Features tailored to your journey

What Bloomest Is NOT

  • A replacement for medical care, therapy, or counseling

  • An emergency service (if you're in crisis, call emergency services or a crisis hotline)

  • A diagnostic tool for medical or mental health conditions

  • A substitute for professional medical advice

If you're experiencing a mental health emergency, please contact emergency services immediately.

3. Content Ownership and Usage

Our Content

All content on Bloomest (text, graphics, software, AI responses, design elements) is owned by us or our licensors and protected by intellectual property laws.

What You Can Do:

  • Use content for personal, non-commercial purposes

  • Save or download content explicitly marked as downloadable

What You Cannot Do:

  • Copy, redistribute, or sell any Bloomest content

  • Modify, reverse engineer, or create derivative works

  • Use content for commercial purposes

  • Remove copyright notices or attributions

  • Share your account access with others

Your Content

When you communicate with Bloomest:

  • You retain ownership of the content you share

  • You grant us permission to use your content to provide and improve our services

  • We process your conversations according to our Privacy Policy

  • You're responsible for ensuring your content doesn't violate others' rights

4. Acceptable Use Policy

You Agree NOT To:

  • Use Bloomest for any illegal purpose

  • Harass, abuse, or harm others

  • Impersonate any person or entity

  • Attempt to hack, disrupt, or compromise the service

  • Use automated tools (bots, scrapers) without permission

  • Upload viruses, malware, or malicious code

  • Collect data about other users

  • Violate any applicable laws or regulations

  • Use the service in any way that could damage our reputation or business

Our Rights

If you violate these Terms, we may:

  • Suspend or terminate your account

  • Remove violating content

  • Report illegal activity to authorities

  • Take legal action to protect our rights

5. Subscriptions and Payments

Free Trial

  • New users receive a limited free trial period (duration specified in-app)

  • Some features may not be available during the trial

  • Important: The trial automatically converts to a paid subscription unless you cancel before it ends

  • Trials are non-renewable (one per user)

Paid Subscriptions

How Subscriptions Work:

  • Subscriptions are open-ended (continue until you cancel)

  • Billing begins immediately after your free trial ends

  • Automatically renew at the end of each billing cycle

  • Payment is charged to your Apple Account or payment method on file

Apple App Store Subscriptions:

  • Managed through your Apple Account

  • Auto-renew unless cancelled at least 24 hours before the period ends

  • Charges occur within 24 hours before the current period expires

  • Manage or cancel in your Apple App Store account settings

Pricing

  • Prices are displayed in your local currency and include all applicable taxes

  • We reserve the right to change prices with notice

  • Price changes don't affect your current billing cycle

  • Special offers and discounts are at our discretion and may have additional terms

Coupons and Promotions

If you use a promotional coupon:

  • Valid only within the specified timeframe

  • Must be applied in full at purchase (no partial use)

  • Cannot be combined with other offers

  • No cash value or refunds for unused portions

  • Intended for personal, non-commercial use only

Payment Processing

  • Payments are processed by Stripe and Apple (we never see your full credit card details)

  • Failed payments may result in service interruption

  • You're responsible for all charges, fees, and taxes

  • We're not responsible for payment processor fees or issues

6. Cancellation and Refunds

How to Cancel

Method 1 - Apple App Store:

  1. Go to your iPhone Settings

  2. Tap your name → Subscriptions

  3. Select Bloomest → Cancel Subscription

Method 2 - Contact Us:

When Cancellation Takes Effect:

  • Your access continues until the end of your current paid period

  • No refunds for partial months

  • After cancellation, you lose access to premium features

Right of Withdrawal (Consumer Protection Rights)

Different rights apply based on your location:

For EU Users (14-Day Right of Withdrawal):

  • You can withdraw within 14 days of subscribing

  • No reason needed

  • Full refund if service hasn't been performed

  • Proportional refund if you've used the service

  • Send withdrawal notice to breathe@bloomest.app

  • Refunds processed within 14 days of notification

For UK Users (14-Day Right to Cancel):

  • Same rights as EU users

  • Cancel within 14 days for any reason

  • Proportional refund based on usage

For Brazilian Users (7-Day Right of Regret):

  • Withdraw within 7 days of subscribing

  • Only if service hasn't been provided yet

  • Full refund within 14 days

Important: These rights are waived if you explicitly request immediate service access and begin using premium features.

Refund Policy

  • Refunds are processed to your original payment method

  • Allow 5-10 business days for processing

  • No refunds for:

    • Completed billing periods

    • Violation of these Terms

    • Services already consumed

    • Change of mind after withdrawal period

7. Service Modifications and Interruptions

We May Modify Bloomest

We continuously improve Bloomest and may:

  • Add, change, or remove features

  • Update content and AI capabilities

  • Modify pricing (with notice for existing subscribers)

  • Change service structure

Your Rights Regarding Modifications:

  • We'll notify you of significant changes

  • If changes negatively impact your use, you may:

    • Continue using the unmodified version (if possible), or

    • Terminate within 30 days of notification

Service Interruptions

Bloomest may be unavailable due to:

  • Scheduled maintenance (we'll notify you when possible)

  • System updates and improvements

  • Technical issues beyond our control

  • Force majeure events (natural disasters, infrastructure failures)

If We Discontinue Bloomest:

  • We'll provide advance notice

  • Help you export your data

  • Respect your rights under applicable law

  • May offer prorated refunds

8. Warranties and Guarantees

Our Limited Warranty

  • We strive to provide reliable, high-quality service

  • We don't guarantee uninterrupted or error-free service

  • Content may contain inaccuracies despite our best efforts

EU Conformity Guarantee

EU users benefit from a 2-year legal guarantee of conformity for digital products. We'll ensure Bloomest conforms to our description and remains functional.

Your Obligations:

  • Install updates when prompted

  • Failure to update may void conformity claims

UK Consumer Rights

UK users have statutory rights to receive services that conform to the contract and are fit for purpose.

Brazilian Consumer Rights

For Goods (if applicable):

  • Non-durable: 30-day guarantee

  • Durable: 90-day guarantee

For Services:

  • Non-durable: 30-day guarantee

  • Durable: 90-day guarantee

Disclaimer (Where Permitted by Law)

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Bloomest is provided "AS IS" and "AS AVAILABLE"

  • We disclaim all warranties, express or implied

  • We don't guarantee specific results or outcomes

  • Third-party services are beyond our control

  • You use Bloomest at your own risk

This doesn't affect your statutory consumer rights.

9. Limitation of Liability

What We're Liable For

We're liable for:

  • Damages caused by our intentional misconduct or gross negligence

  • Injury to life, health, or physical integrity

  • Breach of material contractual obligations

What We're NOT Liable For (Where Permitted by Law)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE'RE NOT LIABLE FOR:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or business opportunities

  • Damages from unauthorized access to your account

  • Service interruptions or technical issues

  • Third-party content or services

  • User error or misuse

Maximum Liability: Where liability applies, it's limited to the amount you paid in the 12 months before the claim (or the duration of your subscription, whichever is shorter).

US Users - Important Notice

Some states don't allow exclusion of implied warranties or limitation of liability for incidental/consequential damages. If you're in such a state, these limitations may not apply to you.

Australian Users

Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your violation of these Terms

  • Your violation of any law or regulation

  • Your violation of third-party rights

  • Content you submit through your account

  • Your misuse of Bloomest

  • Negligence or willful misconduct

11. Intellectual Property

Our IP Rights

  • Bloomest name, logo, and branding are our trademarks

  • All software, code, and AI models are proprietary

  • You receive a limited license to use Bloomest (not ownership)

  • This license is personal, non-transferable, and revocable

Respect Others' IP

  • Don't upload content that infringes copyrights

  • Don't impersonate brands or individuals

  • Report IP infringement to breathe@bloomest.app

12. Privacy and Data Protection

Your privacy matters to us. Please review our [Privacy Policy] to understand:

  • What data we collect

  • How we use and protect your information

  • Your privacy rights

  • Third-party data processing

Key Points:

  • We process data according to applicable privacy laws (GDPR, CCPA, etc.)

  • Your conversations with Laurence are processed by OpenAI

  • We use Firebase, Stripe, and other services (see Privacy Policy)

  • You can request data access, correction, or deletion anytime

13. Dispute Resolution

Try Talking to Us First

Before legal action, please contact us at breathe@bloomest.app. We'll try to resolve disputes amicably.

Our Process:

  • Submit a complaint describing the issue

  • Include relevant details (order number, account info)

  • We'll respond within 2 business days

  • We'll work toward a resolution in good faith

Governing Law

These Terms are governed by:

  • Default: Laws of Ontario, Canada (where we're based)

  • Consumer Protection: If your local consumer protection laws provide greater rights, those apply instead

Special Cases:

  • Swiss Consumers: Swiss law applies

  • Brazilian Consumers: Brazilian law applies

  • EU/UK/Norway/Iceland Consumers: Your local consumer protection laws apply

Jurisdiction

Disputes are resolved in the courts of Ottawa, Ontario, Canada, EXCEPT:

  • EU, UK, Swiss, Norwegian, and Icelandic consumers may bring claims in their home courts

  • Brazilian consumers may bring claims in Brazilian courts

14. General Provisions

Changes to These Terms

We may update these Terms to reflect:

  • New features or services

  • Legal requirements

  • Business changes

How We Notify You:

  • In-app notification

  • Email (if legally required)

  • Posted on this page

Your Options:

  • Continue using Bloomest = acceptance of new Terms

  • Disagree with changes = stop using the service and cancel

Effective Date: Changes take effect on the date specified in the notification.

Assignment

  • We may transfer these Terms to another company (we'll notify you)

  • You cannot transfer your rights without our written permission

Severability

If any provision is invalid or unenforceable:

  • Remaining provisions stay in effect

  • We'll replace invalid provisions with valid ones having similar intent

No Waiver

Our failure to enforce any right doesn't waive that right. All rights reserved.

Entire Agreement

These Terms (plus our Privacy Policy) constitute the entire agreement between you and Bloomest.

Third-Party Services

  • Apple may enforce these Terms if you downloaded from the App Store

  • Third-party services have their own terms

  • We're not responsible for third-party services
